- Acceptance and Modification of the Terms of Use
- Your access and use of the websites (the "Websites") of Nestlé Nespresso S.A. ("Nespresso"), which includes Nespresso's affiliated companies, are governed by the present terms of use (the "Terms of Use"). By accessing, browsing and using our Websites you acknowledge that you have read, understood and accepted, without reserve, these Terms of Use, as modified from time to time by us.
- If we decide to modify our Terms of Use, we will post a new dated version on our Websites. Therefore, we invite you to consult these Terms of Use from time to time in order to familiarise yourself with any changes.
- Copyright and Intellectual Property
- The content of our Websites and namely but not exclusively the texts, marks, logos, diagrams, photographs, videos, sounds, music, layout, designs, know-how, technologies, products and processes are the property of Nespresso or its affiliated companies or are used with the authorisation of the owners, and accordingly are protected by copyright, trademarks, patents and all other intellectual or industrial property rights which exist under applicable law.
- Except as provided in Section 3 hereinafter, nothing contained on our Websites shall be interpreted or construed as granting you a licence or a right to use any such content of our Websites.
- Use of the Website
- You may download, display or print the content of our Websites solely for personal, non-commercial use, thereby retaining and reproducing each and every copyright notice or other proprietary rights notice contained in any information or other material you download. Any other use, including the reproduction, modification, distribution, transmission or broadcast of the content of the Websites, in whole or in part and by any means, is strictly prohibited, except upon prior written consent of Nespresso.
- Nespresso neither warrants nor represents that your use of any content displayed on its Websites will not infringe rights of third parties.
- Information Deemed Non-Confidential
- Any personally identifying data and information that you may send via the Internet to our Websites are protected and treated according to our Privacy Policy. Nespresso invites you to read this Privacy Policy carefully before providing us with any personally identifying data and information.
- Any other information or material communicated to Nespresso through the Internet, by electronic mail or otherwise, including any data, questions, comments, suggestions, ideas, graphics or the like, are and will be treated as non-confidential and non-proprietary. Anything you transmit or post becomes the property of Nespresso and may be freely used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Specifically, Nespresso is free to use any ideas, concepts, know-how or techniques contained in any such communication you send to the Websites for any purpose whatsoever, including, but not limited to, developing, manufacturing, advertising and marketing products using such information. Any such use is without compensation to those providing the information, nor anyone else.
- By submitting information, you are warranting that you own the material/content submitted, that it is not defamatory, and that Nespresso's use will not violate any third party’s rights. Nespresso is under no obligation to use the information provided.
- Disclaimer of Warranties
- Without prejudice to section 6 hereinafter, any material, information and all that you find on the websites are provided to you “as is”, in function of their availability and without guaranty of any sort, express or implied, including, among others, the implied warranty of merchantibility or fitness for any particular purpose.
- Nespresso does not guarantee that its websites or their content will correspond to your expectations, will not be interrupted, timely, secure and free of error.
- Some jurisdiction may not allow certain limitations of warranties, so some of the above exclusions may not apply to you.
- Any advice or information, be it oral or written, obtained from Nespresso or during the use of services made available on the Websites, shall not give rise to any guarantees which are not expressly provided for in the present Terms of Use.
- Limitation of Liability
- You access, use, browse and navigate on our Websites at your own risk and peril.
- You recognise and accept that, to the fullest extent permitted by applicable regulations, neither nespresso, any of its affiliated companies, nor any other party involved in creating, producing or delivering the websites, may be held liable for any direct, indirect or consequential damages, any injury to reputation, costs, losses, decrease in turnover or profits or liabilities of any nature whatsoever (even if the advent of such damage was known or could have been known by nespresso), capable of arising from your access to or use of, or on the contrary the impossibility to use, the websites or their content.
- All materials which are downloaded or obtained in any other manner during the use of our websites are at your own risk and peril. nespresso assumes no liability for any damage or virus which could affect your computer, tis equipment or other property due to your access to, use or downloading of any material from nespresso's websites or for any illegal intrusion or intervention in the it systems.
- Nespresso reserves the right to interrupt or discontinue any or all of the functionality of its Websites. Nespresso accepts no responsibility or liability whatsoever for any interruption or discontinuance of any or all functionality of its Websites resulting from actions or omissions of Nespresso or any third party.
- Change of Information
The content of our Websites may contain inaccuracies or errors. Nespresso reserves the right to make changes, corrections and/or improvements to such content any time without prior notice but does not assume any responsibility to do so.
- Availability of Products / Services
Our Websites may contain information on Nespresso’s worldwide products and services, not all of which are available in every location. A reference to a Nespresso product or service on the Websites does not imply that such product or service is or will be available at your location.
- Links
- As a service to our visitors, our Websites may contain hypertext links leading to other websites that are not operated or controlled by Nespresso. Nespresso shall not be considered as responsible for these sites and declines all responsibility and liability in relation to their content, legality, accuracy or functions.
- The creation of any hyperlink to our Websites is prohibited without prior written consent of Nespresso.
- Miscellaneous
- The present Terms of Use embody the entire agreement concluded between Nespresso and yourself concerning the access and the use of the Websites and their content. Any other terms or conditions issued by Nespresso and governing its relations with you, in particular relating to any service or purchase of product, shall supplement the Terms of Use; in the event of any inconsistency between them, the other terms or conditions shall prevail over these Terms of Use.
- The fact that Nespresso tolerates a violation by yourself of one of the obligations set out in the Terms of Use, or does not enforce a right attributed to it thereunder or under the law shall not be construed as a waiver by it to invoke and enforce its rights.
- In the event that any provision of the Terms of Use is considered to be illegal by law or regulation, existing or future, or by a court ruling, then such provision shall be considered as stricken, all other provisions of the Terms of Use maintaining full force and effect between yourself and Nespresso.
- The headings of the provisions of the Terms of Use are for convenience alone and shall not alter or modify the terms and conditions in any manner.

Terms & Conditions Nespresso Club Loyalty Program - KSA MARKET
The Terms and Conditions detailed below are intended to define the characteristics and operating conditions of the loyalty program called “Nespresso Club” aimed at customers and potential customers of the “Nespresso” brand whose owner is the company Nestle Nespresso SA, with registered address Chaussée de la Guinguette 10, 1800 Vevey, Switzerland.
- WHO CAN PARTICIPATE IN THE PROGRAM?
Any natural person who fulfills the following requirements is part of the Nespresso Club:
- Has a Nespresso registered customer account in Saudi Arabia.
- Has at least one paid coffee order the last 12 months.
Nespresso Club has been conceived as a program inherent to registration as a Nespresso customer and after the first paid coffee order. This program does not apply to Nespresso Professional customers.
- HOW DO I JOIN THE PROGRAM?
When customers place their first coffee purchase with their Nespresso account, whether it's from Nespresso Boutiques in Saudi Arabia, Nespresso.com website, the Nespresso Mobile App, or the Call Centre, they are automatically enrolled into Nespresso Club.
To participate in the points system collection and redemption, customers need to give the consent/opt-in.
Nespresso Club is totally free of charge for the customers.
- WHAT DOES THE PROGRAM CONSIST OF?
Nespresso Club offers a range of benefits to all our members, as well as the opportunity to collect and use points. By tracking customer annual coffee consumption, the customer can progress through Nespresso membership status, starting from Club Member and advancing to Ambassador. To achieve Ambassador status, the annual coffee consumption needs to exceed 700 capsules. As an Ambassador, the customer will enjoy even more exclusive benefits and collect more points on the purchases.
All the paid capsules (original and vertuo line) purchased under the customer account directly from Nespresso Boutiques, Nespresso.com, Mobile App or the Call Centre are taken into account. For example, if the customer joined Nespresso in March (1st coffee order), the coffee consumption will be calculated based on the customer purchases from March to February of the following year. The status upgrade to Ambassador level will be reflected one day after the customer receives the coffee order that grants the customer access to this level. On the other hand, any downgrade in status will occur at the end of the membership month.
The status can be consulted any time via the "My Account" section, or through the coffee specialists in Nespresso Boutique or Call Center.
During the first 6 months after the customer places the initial coffee order, the customer will experience the benefits of Nespresso onboarding journey.
- ACCUMULATION OF POINTS
To start collecting and using points, the customer must provide consent/opt-in at any time through "My Account".
When opting-in the customer gives explicit consent to Nespresso to accurately calculate and allocate points based on eligible transactions. Nespresso will process personal data in compliance with data protection laws and privacy regulations in Saudi Arabia.
- Accumulation of points through purchases
- New Member (first 6 months): 1 SAR = 5 Points
- Member (after 6 months and less than 700 capsules/year): 1 SAR = 10 Points
- Ambassador (after 6 months and more than 700 capsules/year): 1 SAR = 12 Points
Customer will collect points in all coffee, machine and accessory purchases in all Nespresso Boutiques in Saudi Arabia, Nespresso.com, Mobile App, or the Call Centre.
For each identified product purchase made, the customer may accumulate points in accordance with the following formula:
Customers may earn extra points by participating in Nespresso's seasonal campaigns. The specific conditions and number of extra points will be communicated during each campaign.
Customers will receive an additional 4000 points on their first purchase made through the Nespresso Application.
Points collected on coffee purchases are available immediately. Points collected on other products will be available 14 days after the initial accumulation (purchase date), provided that they have not been returned within the return period set out by Nespresso.
Purchases made before opting-in do not accrue points retroactively. To collect points on all future purchases, make sure to opt-in before making any transactions.
Due to the delay in the points availability, the customer will see two balances in “My Account”: Total Point Balance (for unexpired/unused points) and the Available Points Balance (for points that can be exchanged for cashback). The customer can find the information in boutiques (printed ticket) or via coffee specialists, via Call Center coffee specialists and in the Nespresso.com and Mobile App customer profile page. During pilot phase, the customer will not be able to access to point accumulation history, but can be consulted with coffee specialists in Boutiques or via Call Center at 8001166612.
- EXPIRATION OF POINTS
Points collected have an expiration period of 12 natural months from the date they become available for use. For instance, if points are collected and made available on January 12, 2024, they will expire on February 1, 2025, at approximately midnight. Once points expire, they cannot be used, and this expiration will be reflected in the total number of points credited to your account. Therefore, Nespresso encourages customers to regularly monitor their points and take advantage of them before they reach their expiration date to fully benefit from Nespresso loyalty program.
- TRANSFER OF POINTS
The points collected through Nespresso Club do not constitute property of the Consumer and cannot be transferred or assigned by the Consumer under any circumstances. Any sale or transfer of points will be deemed null and void.
However, if a customer has made purchases using two different accounts but both accounts are held by the same customer, the customer may request to have the accounts merged by contacting the Nespresso call center at 8001166612. Nespresso reserves the right to verify the customer identity to ensure that both accounts are held by the customer before proceeding with the accounts merger.
- REDEMEPTION OF POINTS
For the current pilot, customers may only exchange their accumulated points for cashback on future purchases. The conversion rate of points to SAR for cashback will be communicated by Nespresso.
- GENERAL RULES OF OPERATION
Without prejudice to the provisions of the preceding sections, the general operating rules regarding the accumulation and exchange of points are set out below:
- Both the accumulation of points and their redemption will be calculated in whole numbers (in other words, rounded quantities, without decimals).
- Shipping and product alteration costs will not result in the accumulation of points.
- The points accumulated through the purchase of products will be calculated based on the final amount of the purchase receipt after deducting any discounts, promotions, or returns, wherever applicable.
- The accumulated points will be available for redemption in the upcoming order (not in the same order).
- The customer cannot accumulate or redeem points in Nespresso Boutiques located outside of Saudi Arabia.
- The redemption of points may be combined with any other payment method.
- It will be possible to accumulate and redeem points during sale periods or promotions.
- Nespresso does not guarantee the availability and continued operation of the Program whenever technical reasons (e.g. error in the operation of systems, servers, computer equipment, internet) or force majeure prevent this, and therefore will not assume any liability for any damages that may be derived from a lack of continuity in the operation of the Program. However, and wherever possible, Nespresso will make every effort to notify the customers of such incidents.
- The program will run as a pilot for 6months and extend based on performance.
- PROCEDURES FOR RETURNS AND/OR EXCHANGES OF PRODUCTS
Points collected on products that can be returned within the next 14 days, will not be available until 14 days after the initial accumulation (purchase date). In case of returns, the collected points will be deducted.
As for Nespresso points collecting policy for product exchanges, if the customers exchanges a product within the exchange period set out by Nespresso, the points originally collected from the original purchase will be adjusted to reflect the new transaction. This ensures that points accurately reflect the updated purchase and exchange transactions. If the customer has any specific inquiries about points related to product exchanges, please do not hesitate to contact Nespresso Call Center for assistance.
- WITHDRAWL FROM THE PROGRAM
Customers who wish to cancel their subscription to the Program may do so at any time by contacting the Nespresso Call Centre at 8001166612. Upon cancellation, the customer will lose all accumulated points, and any other benefits associated with the Program.
You can always choose to opt-out from the Nespresso points system through "My Account", but you will remain Nespresso Club member until you become inactive (no coffee order during 12 consecutive months).
Please be aware that Nespresso reserves the right to retain your personal information even after you have dropped out or opted out of the Nespresso Club. This retention of personal data is subject to our privacy policies and applicable data protection laws and regulations, ensuring that we maintain necessary records for legal and operational purposes.
- ENTRY INTO FORCE AND DURATION
The Program enters into force on [insert start date] and will have a definite duration as a pilot until [insert end date] where it will be assessed and potentially continued.
Notwithstanding the foregoing, Nespresso reserves the right to cancel or modify the T&C of the Program at any time. In this case, Nespresso will inform the customers in advance through the communication channels which, wherever applicable, it enables for said purpose (e-mail, website, etc.). The modification or cancellation of the T&C of the Program shall not entitle the customer to any compensation.
- PROCESSING OF PERSONAL DATA
For more information regarding the processing of personal data, the customer may consult the Privacy Policy available on the Nespresso Saudi website.
- APPLICABLE LAW AND JURISDICTION
The T&C will be regulated by the local legislation that is applicable to each customer in Saudi Arabia.
For the resolution of any discrepancies that may arise from the interpretation and/or execution of the T&C, and unless required by applicable local legislation, Nespresso and the customer submit, expressly waiving any other jurisdiction that may correspond to them, to the jurisdiction of the courts of Saudi Arabia.
- FRAUD
Nespresso reserves the right to initiate whatever action it deems appropriate in the event of detecting fraudulent or suspicious behavior by customers who are not making proper use of the benefits offered by the Program.
